DJI, the world’s largest maker of drones, has filed a lawsuit against the U.S. Department of Defense (DoD). The Chinese company is challenging its inclusion on a blacklist that names it as a “Chinese Military Company” (CMC). This lawsuit, filed in October 2023, follows more than a year of DJI trying to talk to the U.S. government to resolve the issue without going to court.

The problem started in 2022, when the U.S. government decided to add DJI to the CMC blacklist. This list includes companies that the U.S. believes have ties to the Chinese military. Being on this list means there are serious limits on how the company can do business in the U.S., including possible sanctions.

The company argues that this label is completely wrong. The company has always said that it makes drones for regular people, businesses, and emergency services, not for military purposes. In fact, the company has been clear about not wanting its drones to be used in wars. They even stopped selling their products in Russia and Ukraine to avoid their drones being used in the ongoing conflict between the two countries.

DJI tried for 16 months to talk with the DoD and get their name removed from the blacklist, but nothing worked. Now, DJI is taking the matter to court, saying they were wrongly placed on the list and want their name cleared.

A researcher from the Chinese Academy of Social Sciences, Lü Xiang, said that DJI’s lawsuit will help the company show the world it isn’t tied to the military and only wants to build a positive image as a technology leader.

However, not everyone thinks DJI’s case will be successful. Lawsuits against the U.S. government, especially when they involve national security issues, are often very difficult to win. The U.S. government can argue that it is protecting national interests, which makes it tough for companies like DJI to change the outcome. But even if the company doesn’t win right away, this case is already drawing attention and could help more people understand that the company sees itself as a maker of civilian technology, not military equipment.
