Billionaire entrepreneur Elon Musk has accused the Democratic Party of using fraudulent IRS refund payments to attract and keep illegal immigrants in the United States.

In a recent post on X, he claimed that fraudulent tax refunds are being used as a tool to secure long-term political power. He stated that such payments are a part of a larger strategy to create a permanent majority for the party across the country.

Musk’s statement came in response to a video from journalist Savannah Hernandez, which showed a Jackson Hewitt tax service employee allegedly advising undocumented immigrants on how to claim tax refunds of up to $14,000. This employee was reportedly handing out flyers outside a migrant shelter in New York City, offering tax-filing services and listing possible refund amounts under tax credit programs.

Musk expressed frustration over what he believes to be an unfair system, stating that taxpayers’ money is being used to fund these payments fraudulently. He argued that this practice needs to be stopped immediately to prevent long-term political manipulation.

How Tax Refunds Work for Immigrants

In the debate that followed, many people questioned whether undocumented immigrants are actually receiving fraudulent tax refunds. Some pointed out that, in order to receive any refund from the IRS, a person must have a taxpayer identification number, meaning they must be in the system and paying taxes in some form.

The IRS issues Social Security numbers to individuals who enter the country legally and go through the immigration process. Some immigrants, including those who are undocumented, may instead receive an Individual Taxpayer Identification Number (ITIN). This allows them to pay taxes on earned income and property. However, people with ITINs are not eligible for the same tax credits that legal residents or citizens can claim.

The largest tax credits, such as the Earned Income Tax Credit (EITC), require a person to have earned income and a valid Social Security number. The Child Tax Credit (CTC), however, does not require earned income, meaning some individuals may qualify even if they did not work. That said, only lawfully present individuals are eligible for these benefits.

According to official records, undocumented workers paid nearly $60 billion in taxes in a recent year. However, they do not receive the benefits of Social Security, Medicare, or unemployment insurance, despite contributing to these programs.

Are These Refunds Really Fraudulent?

The controversy began with the circulation of Jackson Hewitt tax service flyers outside a migrant shelter. These flyers, written in Spanish, advertised tax filing services and listed available tax credits. Some viewed this as proof that undocumented immigrants were being advised on how to claim government money fraudulently. However, tax experts argue that helping people understand tax laws does not necessarily mean fraud is taking place.

For fraud to occur, tax forms would need to be falsified to claim benefits that individuals are not legally entitled to. Simply informing people of legally available credits does not constitute fraud.

Many online users questioned the logic of the accusations. Some pointed out that if undocumented immigrants are receiving tax refunds, it means they are paying taxes in the first place. Others highlighted that a private tax service offering help to individuals has no direct link to the IRS committing fraud.

As the debate continues, frustration grows among those who believe taxpayer money is being misused. Elon Musk remains firm in his belief that these payments should be stopped to prevent what he sees as an unfair system.
