In a dramatic financial scandal, Timothy McPhee and Heath Posey, two men from Colorado, have been charged with running a fraudulent investment scheme. Their operation, known as the “ROI Cash Flow Fund,” allegedly duped more than 50 investors out of $8 million. Investors were promised their funds would be used for foreign exchange (forex) trading, generating a 3% monthly return on their principal. However, according to federal investigators, these promises were nothing but lies.

The indictment, unsealed today, outlines how McPhee, from Estes Park, and Posey, from Denver, misled their victims from January 2023 to February 2024. They assured investors that their money would be leveraged for forex trading and returned with profits. This promise of guaranteed returns lured people into trusting them with significant amounts of money.

But instead of using the funds for legitimate trading, McPhee and Posey allegedly funneled millions into personal accounts, enriching themselves and perpetuating the illusion of success. Prosecutors have labeled this operation as a fraudulent scheme, accusing the pair of betraying the trust of their investors.

Where Did the Money Really Go?

Despite their grand claims about forex trading, McPhee and Posey reportedly never used the funds for this purpose. Instead, the indictment states they relied on a scheme often called a “Ponzi scheme.” In such schemes, money from new investors is used to pay earlier investors, making it appear as though the operation is profitable. This tactic helps fraudsters maintain the illusion of success and attract even more unsuspecting victims.

From June to December 2023, McPhee is accused of transferring over $2 million into his personal bank account. These funds, meant for investment purposes, were allegedly spent on personal expenses and unrelated investments. Similarly, in February 2024, McPhee and Posey are accused of moving nearly $500,000 into another account under their control. This money was reportedly used to pay for their other business ventures and Posey’s salary, rather than being invested as promised.

The indictment reveals the extent of the alleged deception. By manipulating the flow of funds and providing payouts to some investors using other investors’ money, McPhee and Posey created the false impression of a thriving and profitable investment fund.

Serious Legal Consequences for McPhee and Posey

If convicted, McPhee and Posey face severe penalties for their alleged crimes. The charges include wire fraud, conspiracy to commit wire fraud, and money laundering. Each count of wire fraud carries a maximum penalty of 20 years in prison. Similarly, conspiring to commit wire fraud could result in another 20 years behind bars. Additionally, each count of money laundering carries a potential 10-year prison sentence.

California Attorney Krueger Charged with Tax Evasion and Fraud

The charges stem from an extensive investigation led by the FBI. Prosecutors from the Justice Department’s Tax Division are handling the case. Acting Deputy Assistant Attorney General Stuart M. Goldberg announced the indictment, highlighting the serious nature of the charges and the alleged betrayal of investor trust.

It’s important to remember that the indictment is merely an allegation. McPhee and Posey are considered innocent until proven guilty in a court of law. As the case proceeds, the evidence will determine their fate, and a federal judge will decide their sentences if they are convicted.

This case serves as a reminder of how easily people can fall victim to financial scams, especially when promises of high returns seem too good to be true. The alleged actions of McPhee and Posey left a trail of financial harm and broken trust. For the victims, many of whom invested their savings in hopes of securing a better financial future, the losses go beyond money.

The legal system will now work to address the alleged fraud, hold the accused accountable, and deliver justice for those who were misled. The FBI continues to investigate, with prosecutors aiming to bring the case to trial and ensure the facts are laid bare.

While the legal process unfolds, this case underscores the importance of caution in financial dealings and the devastating consequences of misplaced trust. McPhee and Posey now face the daunting task of defending themselves against these serious accusations in court.
