PMLA Special Court in Chennai Convicts R. Sekar and K. Anwar Hussain: Sentenced and 5,000 Fine Each

By order dated January 11, 2024, the Hon’ble PMLA Special Court in Chennai found R. Sekar and K. Anwar Hussain guilty of violating the PMLA of 2002, sent them to three years of Rigorous Imprisonment (RI), and fined each accused in the prosecution’s case Rs. 5,000. The prosecution filed this complaint in 2015 against two defendants, K. Anwar Hussain and R. Sekar. 

In his capacity as Protector of Emigrants & Director, O/o Protector of Emigrants (POE), Chennai, between January 2007 and July 2009, R. Sekar, the accused, and K. Anwar Hussain, a travel agent with M/s Classic Tours & Travels, another accused, engaged in a criminal conspiracy. 

Additionally, by misusing his official position, he obtained bribes in the form of fast money and other items from several recruiting agents via the aforementioned K. Anwar Hussain in exchange for granting their clients immigration permission, totalling Rs. 2,03,94,900. Therefore, among other things, R. Sekar and K. Anwar Hussain have committed offences that are scheduled offences under PMLA, 2002 and are punishable by the provisions of IPC, 1860 and the Prevention of Corruption Act, 1988. 

Proceeds of the Crime (PoC) linked to a criminal conspiracy that amounted to Rs. 2,03,94,900 were temporarily attached by the ED throughout the course of the inquiry, and the Hon’ble Adjudicating Authority, PMLA, New Delhi, later verified the same.
