Rahul Bhardwaj and Mukesh Kumar Bhardwaj were found guilty of violating the PMLA of 2002 by the Special Session Court (PMLA, 2002)/Special Court, CBI-3, Jaipur Metropolitan-I, designated Special Court for PMLA, Jaipur. On June 9, 2023, they were sentenced to four years of solitary confinement and a fine of Rs. 1,00,000/- in the prosecution case. The Honourable Court also ordered the forfeiture of all the properties attached by the ED in accordance with PMLA, 2002, totalling Rs. 1,55,00,145. 

In the current case, the DRI searched Rahul and Mukesh Kumar Bhardwaj’s home and found 100.642 kg of the psychoactive drug ketamine, Rs. 70.50 lakhs in cash, two automobiles, and other various incriminating documents and technological devices. Following a probe into the situation, DRI on February 5, 2013, filed a complaint against Rahul Bhardwaj and Mukesh Kumar Bhardwaj with the Special Court for NDPS Case in Jaipur. 

Additionally, ED Jaipur filed a money laundering case on March 14, 2013, in accordance with the PMLA, 2002’s provisions, based on the complaint.  

According to the PMLA investigation, the accused Rahul Bhardwaj and Mukesh Bhardwaj exported drugs and psychoactive substances, mostly ketamine, to the United States via post parcel by falsely claiming that they were “documents.” The accused also used a variety of IDs to receive payments sent from overseas buyers of ketamine via Western Union and Money Gramme. 

Properties valued at Rs. 1,55,00,145 had been attached by the ED throughout the course of the inquiry in accordance with the PMLA, 2002, and this had been validated by the Ld. Adjudicating Authority (PMLA), New Delhi. 

Additionally, following an inquiry, a Prosecution Complaint was submitted on March 30, 2016, to the Special Court (PMLA), Jaipur, in accordance with PMLA, 2002. On June 8 and June 9, 2023, the Honourable Court delivered its decision to convict these two defendants.
