Wind Tre S.P.A is an huge Italian Telecommunication company that aids integrated mobile, telephony, and internet services. It came in existence in 2016. This company is regarded as the largest company in Italy for providing divergent Telecom services.

How Did Wind Tre S.P.A got Fined?

On the July 13 2020, the Italian Data Protection Authority (Garante) imposed a fine on Wind Tre S.P.A for General Data Protection Rules of $16.7 Million for violating the illegal data activities taking place in the company. It was in connection to direct marketing.  Garante told that it had imposed trespass in the past under the EU General Data Protection Rules. This is the 2nd largest fine applied by Garante.

At the time of investigation the authority came to know that the users had filed a complaint against the company for unbidden marketing that was taking place without the users consent. For every organization the users are the customers. So its the whole responsibility of the organization to look after the users and there customers problems.

Understanding the case

The complainants announced that they weren’t able to extract consent as well as to object for the processing there personal data for marketing purposes of the company. On account of the inaccurate contact information provided in the information notices. So, most of the users contact names and numbers added to the public phone listing systems. In spite of the users had shown prior objection regarding it.

The investigators found that the different apps developed ling Mywind, My3 App set up the structure by the company for taking the users consent at the time of accessing every time for the purpose of marketing, communication of the data etc.

Wind Tre S.P.A Partner involvement in the case

At the time of investigation , it observed that Wind Tre S.P.A partner involvement were also there in the unlawful data processing. One of the largest business partner of Wind Tre S.P.A fined for EUR 200,000 by the Italian Data Protection Authority for using the data of its agents that they had collected and sent in the national territory without contemplation for the data protection rules. He had subcontracted without any legal instrument. They processed whole set of activities to the call center that occurred in the data breach.

The company is also looking to safeguard the data of there users. It won’t be available to any one in general. They would also look that without the customers and users consent the marketing calls and promotions won’t take place. The company is also implementing the Data Protection Policy. It protected each and every personal information of the users and customers.
