ED Files Disproportionate Assets Case against Bihar Govt. Official and Family; Court Takes Cognizance

In a Disproportionate Assets (DA) Case, the Directorate of Enforcement (ED) filed a Prosecution Complaint (PC) on December 20, 2023, before the Hon’ble Special Court (PMLA), Patna, against Shishir Kumar, the Assistant Engineer at the time, Jila Parishad, Vaishali, Govt. of Bihar, and his family members. On December 20, 2023, the Honourable Special Court of Patna granted the PC cognizance.

In accordance with the provisions of the Indian Penal Code, 1860 and the Prevention of Corruption Act, 1988, the Economic Offence Unit, Patna, Bihar filed a formal complaint (FIR) against Shishir Kumar and others, alleging that they used corrupt and illegal means to amass assets that were out of proportion to their known sources of income during their service period. Based on this information, the ED launched an investigation.

In addition to the properties (of Rs. 1.65 Crore) listed in the charge sheet by EOU, Bihar, Patna, the aforementioned properties, valued at Rs. 2.72 Crore, and were provisionally attached by the ED. The Adjudicating Authority has validated the Provisional Attachment Order that ED issued in this particular case. Additional research is currently being conducted.
